Data Processing Agreement

For business customers subject to GDPR and applicable data protection laws.

Last updated: 7 March 2026  · Effective date: 7 March 2026

Who needs this agreement? This Data Processing Agreement ("DPA") applies to business customers who use Ampifex to generate and publish content and who are subject to GDPR, UK GDPR, or similar data protection laws that require a formal DPA between a controller and a processor.

This DPA is incorporated by reference into the Ampifex Terms of Service and is automatically effective for all business customers. No separate signature is required. If you require a signed DPA (e.g. for enterprise compliance), contact legal@ampifex.com.

1. Definitions

  • "Controller" means the natural or legal person that determines the purposes and means of processing personal data. In the context of this DPA, you (the Ampifex customer) are the Controller.
  • "Processor" means the entity that processes personal data on behalf of the Controller. In the context of this DPA, Ampifex (Smartunex OÜ) is the Processor.
  • "Personal Data" has the meaning given under GDPR Article 4(1): any information relating to an identified or identifiable natural person.
  • "Processing" has the meaning given under GDPR Article 4(2).
  • "Sub-processor" means any third party engaged by Ampifex to process Personal Data on behalf of the Controller.
  • "Data Protection Law" means GDPR, UK GDPR, and any other applicable data protection legislation.
  • "SCCs" means Standard Contractual Clauses as approved by the European Commission for international data transfers.

2. Scope and Nature of Processing

Where you use Ampifex to generate, store, and publish content, and where that content or any associated data (such as Brand Kit data) includes Personal Data relating to your end customers or third parties, Ampifex acts as a Processor processing Personal Data on your behalf.

Subject matter: AI-assisted content generation, content storage, content delivery via Cloudflare, and related service operations.

Duration: The term of your subscription, plus any applicable retention period set out in the Privacy Policy.

Nature: Automated processing of text-based content data to generate draft articles, store approved content, and publish content to your website.

Purpose: Providing the Ampifex content generation and publication service as described in the Terms of Service.

Categories of data subjects: Potentially your website visitors, customers, employees, or other individuals whose Personal Data may be included in content you provide to or create via the Service.

Categories of Personal Data: Names, contact details, and other Personal Data you include in your Brand Kit, content drafts, or published articles.

Note: Ampifex's core service is generating blog content about your business — services you offer, how-to guides, and local information. Such content typically does not involve Personal Data. This DPA applies to the extent that Personal Data is incidentally included in content you create or approve. If you believe your use case involves significant Personal Data processing, contact us to discuss.

3. Ampifex Obligations as Processor

Ampifex agrees to:

  • Process Personal Data only on your documented instructions (including as set out in the Terms of Service and this DPA), unless required to do so by applicable law.
  • Ensure that personnel authorised to process Personal Data are bound by appropriate confidentiality obligations.
  • Implement appropriate technical and organisational security measures in accordance with GDPR Article 32.
  • Obtain your prior written consent before engaging new Sub-processors, subject to the process in Section 5 of this DPA.
  • Assist you in responding to requests from data subjects exercising their rights under Data Protection Law, to the extent this is reasonably possible and relates to Personal Data in the Service.
  • Assist you in meeting your obligations under GDPR Articles 32–36 (security, breach notification, data protection impact assessments, prior consultation), taking into account the nature of processing and the information available to Ampifex.
  • At your choice, delete or return all Personal Data to you at the end of the contract, and delete existing copies unless applicable law requires retention.
  • Make available all information necessary to demonstrate compliance with GDPR Article 28 and allow and contribute to audits and inspections, subject to reasonable notice and confidentiality.
  • Notify you without undue delay (and in any event within 72 hours) after becoming aware of a Personal Data breach affecting Personal Data processed under this DPA.

4. Your Obligations as Controller

You agree to:

  • Comply with all applicable Data Protection Law as Controller, including ensuring you have a lawful basis for processing any Personal Data you submit to the Service.

  • Ampifex will impose data protection obligations on Sub-processors that are no less protective than those in this DPA.
  • Ampifex remains liable to you for the acts and omissions of its Sub-processors to the same extent as if Ampifex had performed the processing directly.
